Rules of Procedure of the Standing Committee
Note: The Standing Committee rules of procedure of 1996 have been made obsolete by Resolution VII.1 (1999) on the composition, roles and responsibilities of the Standing Committee. In general, the Rules of Procedure for the meetings of the Conference of the Parties are used for Standing Committee meetings.
RULES OF PROCEDURE OF THE STANDING COMMITTEE
REPRESENTATION AND ATTENDANCE
Each member of the Standing Committee shall be entitled to be represented at meetings of the Committee by a Representative and an Alternate Representative.
The Representative shall exercise the voting rights of a member. In his/her absence, the Alternate Representative shall act in his/her place.
Parties not members of the Committee shall be entitled to be represented at meetings of the Committee by an observer who shall have the right to participate, but not to vote.
The Committee may invite any other person or representative of any country or organization to participate in its meetings, or for particular agenda items in its meetings.
During each regular meeting of the Conference of the Parties, the members of the Committee shall elect its Chair and Vice-Chair.
The Chair shall preside at meetings of the Committee, approve the provisional agenda prepared by the Bureau, and maintain liaison with the members of the Committee between meetings of the Committee. He/she shall represent the Committee and the Parties as required within the limits of the Committee's mandate, and shall carry out such other functions as may be entrusted to him/her by the Committee.
The Vice-Chair shall assist the Chair in his/her functions, and shall preside at meetings in the absence of the Chair.
The Bureau of the Convention shall provide the secretariat for meetings of the Committee.
The Committee shall normally meet at least once every year.
Meetings of the Committee shall be called at the request of the Chair or of at least three members.
The time and place of meetings shall be determined by the Chair in consultation with the Bureau.
Notice of meetings shall be given by the Bureau to all Parties at least 45 days and, in the case of emergency meetings, at least 14 days in advance of the meeting.
A quorum for a meeting shall consist of five members. No decision shall be taken at a meeting in the absence of a quorum.
Decisions of the Committee shall be taken by consensus unless a vote is requested by the Chair or by three members.
Decisions of the Committee shall be taken by a simple majority of the members present. In the case of a tie, the motion shall be considered as rejected.
A summary record of each meeting shall be prepared by the secretariat as soon as possible and shall be communicated to all Parties.
The Committee shall decide on the working languages of the meetings, but interpretation facilities shall not be provided.
Any member may make a proposal to the Chair for a decision by postal procedure. The Chair shall send the proposal to the secretariat for communication to the members for comment. Comments are to be sent to the secretariat within 30 days of the date of communication. After these 30 days or after the receipt of comments from all members, whichever comes first, the secretariat shall communicate all comments received to the members.
If no objection to a proposal is received by the secretariat within 30 days of the date when the comments on the proposal were communicated, the proposal shall be considered as adopted and notice of the adoption shall be given to all members.
If any member objects to a proposal within the applicable time limit, the proposal shall be referred to the next meeting of the Committee.
The Committee shall report to each regular meeting of the Conference of the Parties.
The Committee shall receive reports from any other committees or working groups established under the Convention.
The Committee shall provide advice and guidance to the Bureau at any time on all matters pertaining to the Convention and its implementation, and shall carry out such other functions as may be entrusted to it by the Conference of the Parties.
In matters not covered by the present Rules, the Rules of Procedure as adopted by the last regular meeting of the Conference of the Parties shall be applied mutatis mutandis.
These Rules shall come into force on adoption by the Committee and may be amended by the Committee as required.
